The K-1 visa lets a U.S. citizen bring a foreign fiancé into the country. This is as long as the couple’s marriage within ninety days of the fiancé’s arrival. Said fiancé has the option of becoming a permanent resident afterward. This option isn’t available for fiancés of lawful permanent residents. They must apply for a marriage-based green card instead.

Qualifications

The government grants a K-1 visa to engaged couples that:

• Have a U.S. citizen sponsor.
• Both partners are legally allowed to marry.
• Met within the past two years.
• The sponsor meets the established minimum income requirements.
• Marry within 90 days of the fiancés arrival.

Additionally, applicants must submit a Form I-129 to U.S. Citizenship and Immigration Services (USCIS). The total application process for a K-1 visa takes about seven to eight months. Couples should plan accordingly.
