DHS Record Sharing Approved

The government passed a new executive order titled “Protecting the National Security and Welfare of the United States and Its Citizens from Criminal Actors and Other Public Safety Threats”. The executive order grants the Department of Homeland Security (DHS) access to the criminal history record information (CHRI) for screening and vetting purposes. The new policy took effect on February 6, 2026.

The government explained the need to share the information stems from numerous U.S. policies, including to protect the welfare and security of its citizens from criminal actors. Monitoring and checking potential public safety and national security is an intrinsic part of the government’s increased scrutiny towards immigration processing. Additionally, the new policy allows DHS record sharing with foreign governments to identify individuals with criminal histories.

Additionally, DHS will give CHRI information to broader immigration enforcement agencies. This includes authorities from countries included in the Visa Waiver Program (VWP). The executive order also mandates reciprocal sharing under bilateral or multilateral agreements or arrangements entered by DHS that contains appropriate safeguards to protect the privacy of U.S. persons and other individuals consistent with applicable law and regulations. The same goes for countries that entered a Preventing and Combating Serious Crime or similar agreement with the United States. The move reinforces the government’s collaborative efforts with other countries regarding immigration enforcement.
