U.S. Citizenship and Immigration Services (USCIS) is issuing new photo id guidance limiting the age photos of foreign nationals can still be use for immigration documents. Once implemented, applicants cannot use photos older than three years on immigration forms. The policy change is effective immediately.
Additionally, any photos not taken by USCIS won’t count as a form of photo id. USCIS explained the policy change ensures all the photos on immigration applications are recent. This helps immigration agents better identify potential cases of immigration fraud and identity theft, per USCIS guidance.
Previously, USCIS allowed individuals to submit the same photo for up to 10 years, even if the person’s appearance significantly changed. According to USCIS, this rule was part of COVID-19 era flexibility and isn’t necessary anymore. The policy falls in line with the Department of Homeland Security’s (DHS) plan to modernize screening and vetting procedures.
Certain immigration forms require a new photo regardless of whether the applicant’s last photo was over three years old. These are:
- Form I-90, Application to Replace Permanent Resident Card.
- Form I-485, Application to Register Permanent Residence or Adjust Status.
- Form N-400, Application for Naturalization.
- Form N-600, Application for Certificate of Citizenship.
Individuals applying for one of these forms should have a new picture taken at a USCIS facility as soon as possible.
