The federal E-Verify system for employers resumed function on October 9, 2025. This was a week after the system went offline at the start of the ongoing government shutdown. Employers must create now cases for any employs hired while the system was offline. The deadline for registering such submissions is October 14.
Creating Cases
Employers filing for foreign workers more than three days after hiring must submit a reason for the delay. If prompted, employers should enter that E-Verify wasn’t available. The E-Verify was unavailable, don’t count towards the three business days have to create a case. Employers creating cases before October 12 aren’t required to give a reason for delay.
Dealing with Mismatches
For Employers unable to contest E-Verify mismatches while the system was down, they’ll have additional time for starting the process. Those with Referral Date Confirmation notices advising action before October 1, 2025 must choose a new date. Employers can pick a new referral date by:
- Printing out a new “Referral Date Confirmation” notice.
- Logging into E-verify and writing in the new date on a current confirmation notice.
- Adding six federal business days to the original date on the confirmation notice.
Employers must contact the Social Security Administration (SSA) or the Department of Homeland Security (DHS) on the newly specified date.

E-Verify expects increased requests for customer support. Individuals seeking help may experience longer delays and response times. Creating cases as soon as possible is therefore highly recommended.
