According to reports, the Biden Administration is considering using executive action to address the issues at the U.S. southern border. As immigration reform efforts in Congress have gone nowhere, the White House feels pressure from state and local leaders to take action. Although Congressional action is far past due, some action is considered necessary.

The Biden administration worked for months with Congressional leaders on a bi-partisan solution. However, as reported, it was never seriously considered. With no hopes of legislation being passed in Congress, the White House is now considering executive action. Specifically, Section 212(f) of the INA which gives the President some authority to stop certain immigrants from coming into the country if their admission is considered ‘detrimental’ to the U.S.

A policy similar to the proposed immigration reform that would let the president close the border when certain levels of crossing are seen is an option. At this time, however, the option is only being considered by the White House with no specific plan to use executive action.
