Hearing Over Floating Barrier at Southern Border Begins

A Texas judge will hear arguments about removing a floating barrier in the Rio Grande River. This barrier was set up by the state of Texas to discourage migrants from crossing the border. The Biden administration expressed concern that this barrier is straining relations with Mexico. The barrier is part of Operation Lone Star, Texas’ initiative for enhancing border security. The judge will consider whether to issue a preliminary injunction that would require the removal of the floating barrier.

The Department of Justice filed a lawsuit saying Texas didn’t get federal government approval for installing the barriers. The Biden administration filed a request for the preliminary injunction just two days after they were installed. The administration argues that Texas is violating two sections of the Rivers and Harbors Act of 1899, which requires authorization from the U.S. Army Corps of Engineers for installing obstructions in navigable waters. Their request also asks o prevent Texas from constructing any new barriers without federal government approval and permits.

Mexico has lodged a diplomatic complaint, stating that the barrier is causing significant harm. The country says it is potentially breaking two international treaties and could disrupt the natural flow of the river.
