E-3 | Specialty Workers from Australia

The E-3 Visa is a nonimmigrant visa for Australian specialty workers. You must be coming to the United States solely to perform services in a specialty occupation. The specialty occupation requires theoretical and practical application of a body of highly specialized knowledge and the attainment of a bachelor’s or higher degree in the specific specialty, or its equivalent, as a minimum for entry into the occupation in the United States.

  • Are a national of Australia
  • Have a legitimate offer of employment in the United States
  • Possess the necessary academic or other qualifying credentials
  • Will fill a position that qualifies as a specialty occupation

  • Appointment confirmation page (if relevant)

  • Evidence of previously issued U.S. visas
  • A job offer letter or other documentation from the prospective United States-based employer
  • Approved Labor Condition Application (LCA), Form ETA 9035E
  • Evidence of the necessary academic or other qualifying credentials
  • A certified copy of any required license or other official permission to practice the occupation in the state of intended employment if so required
  • If you have ever been arrested, cautioned, convicted (if applicable)
  • If you have a medical condition that could have a bearing on your eligibility for a visa (if applicable)
  • If you have been denied entry into or deported, or removed from the United States (if applicable)

How long does an E-3 visa last?

The E-3 visa has an up to 2 years per extension, and has no maximum on the number of extensions, of course, with some exceptions.

Is there a fee to file the E-3?

Yes, there is a $205 filing fee. If you apply online, you can also pay online. If you pay by mail, then you can pay via money order, personal check, cashier’s check, or by credit card using Form G-1450, Authorization for Credit Card Transactions. If you pay by check, you must make your check payable to the U.S. Department of Homeland Security.

How can I file my E-3 form?

You can file your form online or by mail. Filing online allows you to:
