USCIS Updates Form I-129 ahead of H-1B Registration

U.S. Citizenship and Immigration Services (USCIS) recently updated Form I-129 before the start of the FY2027 H-1B Cap registration period. Form I-129 is the petition to register sponsorship for foreign workers, an important part of the H-1B application process. USCIS will keep accepting previous versions of the I-129 until April 1, 2026.

The changed petition asks employers to give additional information about the minimum qualifications for the position, these include:

  • The minimum education requirements for the job.
  • The relevant field of study.
  • Required work experience for the job.
  • Whether the job in question includes any supervisory duties.

The above-mentioned information is the same factors USCIS uses for determining the prevailing wage level for an H-1B role. This is important because the H-1B lottery gives priority to petitioners in higher wage levels. Collecting this information directly from the petition lets USCIS make wage level determinations much easier.

Consistency is Key

The updated petition links two different steps in the H-1B registration process together by requiring employer confirmation for details given earlier in the process. Considering these changes, keeping details consistent across filings is paramount. Key elements that should remain consistent include:

  • The wage level used during registration.
  • The Standard Occupational Classification (SOC) code.
  • The intended work location.
  • The minimum qualifications of the position.

USCIS will still accept previous versions of the I-129 for the duration of the H-1B registration period. However, individuals that haven’t applied yet should file and submit the latest version. Doing so makes it easier for USCIS to determine where prospective beneficiaries stand on the weighted wage-level system.
