The recent uptake in immigration enforcement operations raised scrutiny towards local law enforcement’s cooperation with immigration authorities. Under special scrutiny is local law enforcement’s cooperation with Immigration and Customs Enforcement (ICE). Therefore, many lawmakers proposed holding ICE agents accountable.
Examples of Accountability
After a surge in ICE operations in Chicago, state leaders established the Illinois Accountability Commission. The Commission’s job is collecting evidence about ICE’ actions, including the agency’s leadership, and make accountability recommendations. The commission’s chair explained that conversations with local law enforcement are going well and prosecutions are close to starting.
Prosecutors in Philadelphia and California are considering criminal charges against federal agents too. Other democratic lawmakers are considering banning face covering for federal agents or requesting they identify themselves. Massachusetts created “safe zones” around schools, courthouses, and hospitals, where agents can’t legally detain people.
Examples of Cooperation
While several blue states proposed increasing accountability, lawmakers in red states accommodated ICE agents. Tennessee financially rewards law enforcement agencies for working with ICE. The move caused the number of cooperating law enforcement agencies to skyrocket. Kentucky lawmakers implemented similar policies.
Additionally, Tennessee plans legislation made in partnership with the government making it harder for individuals without legal status to buy a car or receive government benefits. Meanwhile, New Hampshire banned sanctuary cities in January 2025. This means local law enforcement legally can’t impede immigration enforcement operations.
