Government Pushes Court to Drop H-1B Fee Lawsuit

The government pushed back against the Chamber of Commerce’s lawsuit against the one hundred-thousand-dollar H-1B application fee. The lawsuit was initially introduced in October 2025 and seeks a total judicial block against the implementation of the H-1B fee. While not the only lawsuit, the Chamber of Commerce’s represents the most significant effort to block the fee.

The H-1B fee was initially introduced on September 19, 2025. The government explained the fee is part of larger effort to discourage American companies from relying on international workers. The lawsuit argues such sweeping changes to the H-1B program violates the Administrative Procedures Act and poses significant harm to American universities and businesses.

This is mainly due to companies using H-1B beneficiaries to fill entry-level positions, rather than higher level ones. The government claims companies and employers have abused the H-1B application system, hiring disproportionate numbers of foreign workers and excluding American-born ones. Additionally, the new fee will ensure only highly skilled workers are granted H-1B visas instead of entry-level workers. The one-hundred-thousand-dollar H-1B fee is one of many new immigration fees introduced since the start of 2025, another being the five million dollar ‘Gold Card’ visa. Such expenses are intended to help cover visa processing costs, according to immigration authorities. Currently, the lawsuit is still under review.
