A group of attorneys filed a lawsuit challenging the federal government over immigrant fines totaling over $1.8 million. Fines of up to $988 per day are meant to encourage undocumented immigrants to leave the U.S. voluntarily. Fines have been charged to over 21,500 people.
The lawsuit identifies two specific undocumented immigrants and seeks to reach a class-action status. In total, the Trump administration fined over $6 billion since the start of his second term, in conjunction with an immigration crackdown. The fine amount is considered disproportionate with the violations, per the lawsuit, further calling the fines unconstitutional.
The attorneys filling the lawsuit state the undocumented migrants are actively pursuing legal status through the courts. Further, they identify the backlog in the courts and the inherent complexity of the process. In response, the government is pursuing collections by garnishing wages, seizing homes, cars, and other assets.
