DHS Ends Employment Authorization Auto Extension

Following an interim final rule issued by the Department of Homeland Security (DHS), the auto extension of Employment Authorization Documents (EADs) for timely renewal applicants will end on October 30, 2025. This applies to most EAD categories. This reverses the up to 540-day automatic extension that was in place for many applicants who filed their EAD renewals starting in May 2022.

Who won’t receive an automatic Extension

Individuals in the following categories who file a renewal EAD application on or after October 30, 2025, will no longer receive an auto extension per the DHS final rule:

  • Adjustment of Status applicants (Form I-485).
    • Categories C09 and C24.
  • Asylum applicants.
    • Category C08.
  • Dependent spouses.
    • H-4 spouses of H-1B visa holders (Category C26).
    • E-1, E-2, and L-2 spouses (Categories A17 and A18).
  • Refugees and Asylees.
    • Categories A03, A05, and A10.
  • Temporary Protected Status (TPS) beneficiaries.
    • Individuals who file to renew their TPS-based EADs (Categories A12 and C19) will be affected. However, automatic extensions may still be provided through separate Federal Register notices for specific TPS country designations.
  • Other categories.
    • This includes certain applicants for cancellation of removal, withholding of removal, and VAWA self-petitioners, among others.

Who isn’t Affected

  • Renewal applications filed before October 30, 2025.
    • Any individual who filed a qualifying renewal EAD application before the new rule’s effective date will continue to receive the automatic extension of up to 540 days under the prior regulations.
  • Lawful permanent residents (green card holders)
    • These individuals do not need an EAD to work. Their green card serves as proof of their employment authorization.
  • F-1 STEM OPT applicants
    • These students are on a different track. They are eligible for an 180-day automatic extension of their EAD while their STEM OPT extension application is pending, but they are not eligible for the increased 540-day extension.
  • Individuals covered by specific Federal Register notices
    • Certain TPS recipients whose EADs are extended through a specific Federal Register notice are not impacted by this change to the general EAD renewal process.
  • TPS EAD renewal applications filed on or after July 22, 2025
    • A separate law, H.R. 1, implemented by USCIS, provides a different automatic extension for these applicants, lasting up to one year or the duration of their TPS, whichever is shorter.

What this means for affected Individuals

For those in the affected categories, renewal applications filed on or after October 30, 2025, will no longer come with an automatic extension. This means once their EAD expires, they will lose work authorization until USCIS approves their new EAD application. There is a significant risk of employment gaps due to USCIS processing delays. Affected individuals are encouraged to file their EAD renewal applications as early as possible to minimize the chance of a lapse in employment authorization.
