Noncitizen Photographs Mandatory when Entering the U.S.

Taking photographs of a noncitizen entering and leaving the U.S. is now mandatory, per a new rule by the Department of Homeland Security (DHS). The new rule applies to minors too. The public has until December 25, 2025 to comment on the proposed rule change.

According to the DHS, the new rule addresses national security and visa fraud concerns. Under the new policy, Customs and Border Protection (CBP) uses facial comparison technology to test biometric data upon entry. Said technology uses information CBP collects upon departure of noncitizens to build a comprehensive database of who’s moving in and out of the U.S. The Technology will build galleries of facial image templates for travelers expected on flights or other arrival means using traveler data already on file from passport, visa and immigration applications or other interactions a person has had with CBP.

CBP will compare live photographs against those galleries to verify a person’s identity when they first arrive. According to the final rule, the Simplified Arrival program employs facial comparison for entry, while CBP’s exit system for air travel is already running at some locations. Facial and hand entry recognition is fully underway at sea and land crossings.

A full biometric entry and exit system will be implemented within three to five years. Until then, the government will run trials to find the best way of implementing nationwide system. Historically, collecting photographs and fingerprints from a noncitizen was only mandatory at some ports of entry.
