New Catch-and-Revoke Policy for Visa Holders

On April 30, 2025, the U.S. Department of State announced a new catch-and-revoke policy for visa holders in the United States. Foreign nationals visiting or living in the country legally could lose their visa status if they break the law. Secretary of State Rubio explained it as a one-strike catch-and-revoke policy.

The U.S. will make status revocation a more common penalty for noncitizens and foreign residents who break the law. Visa holders with minor violations, such as traffic infractions, have seen their status terminated. While many foreign students’ visas were recently restored, the fact that these terminations were made via a computer algorithm raises concerns about their accuracy.

The State Department clarified they will continue issuing non-immigrant visas to tourists, students, investors, spouses, and children of legal residents. The policy announcement did not explain the spectrum of crimes that could result in status revocation. The State Department also didn’t clarify how the policy would be implemented.

Critics argue the penalties are unnecessary and will deter wealthy, skilled individuals from settling in the U.S. Critics have also pointed to case of individuals who participated in the wave of protests in 2024 losing their status as a possible cause for concern.

Supporters argue that the policy sends a clear message to foreign residents that a U.S. visa is a privilege, not a right. The hope is that a stricter stance will deter individuals with criminal histories from entering the country and people already with visas from committing crimes.
