Delays and Ongoing Challenges in the Spousal Green Card Program

A Texas federal judge extended a temporary hold on the Keeping Families Together spousal green card program. The program, started by the Biden administration in August, allows noncitizen relatives of U.S. citizens to apply for green cards while staying in the U.S. The hold will last for another 14 days, until at least September 23, 2024, pending an expedited hearing.

The program is being challenged by Texas and 15 other states. They argue that it goes beyond the administration’s authority and could have significant financial effects on their states. The judge decided to keep the hold in place while reviewing the arguments from both sides.

A nonprofit group called the Coalition for Humane Immigrant Rights, along with 11 individuals, asked the Fifth Circuit to speed up their appeal after a lower court refused to let them participate in the Texas lawsuit. They want to participate in the case because they believe it directly affects them. However, the lower court refused their request, saying the federal government will represent their interests. The nonprofit argues that their involvement is crucial for presenting important evidence. They are asking for a quick decision on their appeal so they can take participate before the case ends.

Texas opposes the nonprofit’s participation, saying they can still offer their views as “friends of the court” (amici) but argues their evidence might not be relevant. Texas also believes the federal government is already defending the program and has the same goals.
