The second round of H-1B cap selection for FY2025 is now finished. This extra selection was needed to meet the numerical allocation. U.S. Citizenship and Immigration Services (USCIS) believes this second round has selected enough unique beneficiaries to meet the cap. All those who were selected have been informed that they are eligible to file an FY2025 H-1B cap petition for the selected beneficiary.
Only petitioners with selected registrations can file an H-1B cap petition, and only for the beneficiaries chosen in those registrations. There was no second selection for the advanced degree exemption (master’s cap) because the first selection was sufficient to meet that cap.
Those selected have at least 90 days to file their FY2025 H-1B cap petition. Filing online is preferred, just like in the first round. The selection notice must be included with the petition. All petitions must meet the required regulations and prove eligibility for approval.
For the second selection, new fees that went into effect April 1, 2024, are required. Make sure to use the updated Form I-129, dated 04/01/24, as this is the only form accepted for this round. Updated premium processing fees that went into effect February 26, 2024 also apply if you are filing Form I-907.
