Since President Biden ordered a pause on processing asylum claims when illegal border crossings hit certain levels, three weeks ago, the number of border arrests has dropped by more than 40%, according to the Department of Homeland Security. This is part of Biden’s efforts to manage new arrivals at the southern border. The rule, announced in early June, means asylum requests are not accepted when arrivals exceed specific limits.
The Department of Homeland Security reported that the average daily border arrests over a seven-day period are now below 2,400. This is more than 40% lower compared to the average on the day Biden’s order took effect. It marks the lowest rate since January 17, 2021. It remains higher than the 1,500 daily average needed to restart asylum processing.
When illegal crossings exceed 1,500 per day, individuals who express fear or an intention to seek asylum undergo stricter screening by a U.S. asylum officer. If they pass this screening, they may be eligible for other types of humanitarian protection, like the U.S. Convention Against Torture. Legal challenges to the Biden administration’s policy are currently ongoing.
