The Texas migrant arrest law giving officials the ability to arrest and deport migrants has been delayed for a second time by U.S. Supreme Court Justice Alito. The pause extends until March 18, 2024, at 5pm CST. Briefs outlining the effects of the law, known as SB4, were filed over the last week by the federal government, Texas, and legal service providers.
The Texas law was previously temporarily blocked by a lower court as litigation continued. Subsequently, the Fifth Circuit Court granted an administrative stay of the lower court decision and the law took effect. The Biden administration asked the U.S. Supreme Court to vacate the Fifth Circuit court order. However, before the Supreme Court could respond, Justice Alito placed the law on stay for a week.
