The Department of Homeland Security (DHS) is planning to update some employment-based visa policy in 2024. The goal is to increase flexibility for non-immigrant workers and religious workers. Full details of the proposed updates are not yet available.
Updates are expected to address various types of work visas including EB-1, EB-2, and EB-3. DHS is addressing the ability to pay the proffered wage to EB workers as well as what evidentiary documents are required for each preference category.
DHS will also update employment authorization rules for spouses of workers in specific categories and give more flexibility to workers who resign or are terminated. Updates for religious workers likely will include reducing the length of time required outside the U.S. before renewing their visas.
Employment updates are likely to be announced in the second half of 2024, with proposals expected in August and October.
