A federal judge scheduled a hearing on June 1, 2023, prior to deciding if the Deferred Action for Childhood Arrivals (DACA) program is legal and will continue. This review focuses on whether the updated version of the DACA program from the Biden Administration is lawful. During the hearing, oral arguments will be presented. A group of conservative states is challenging the overall legality of the program. A group of DACA recipients has filed opposing motions in response.
This lawsuit adds to the ongoing legal disputes surrounding the DACA program. The program was initially established in 2012 by President Obama through an executive order. DACA offers protection against deportation for individuals brought to the U.S. as minors. In 2021, a federal judge ruled that the DACA policy was illegal, halting new applications. A circuit court upheld this ruling. At the same time, the Biden administration released a Department of Homeland Security (DHS) rule that safeguards hundreds of thousands of DACA recipients from deportation.
