The June 2023 Visa Bulletin has been released by the Department of State. The dates in the visa bulletin are the earliest priority date that will be processed in June 2023. The State Department gives both the Final Action Dates and Date of Filing Applications for Employment-Based and Family-Based immigrant visas monthly. Applicants must use the chart specified by USCIS when filing their Adjustment of Status (AOS) application. We summarize the June 2023 visa bulletin updates in this news piece. Overall, there are not many date changes for the current month compared with May 2023.
Employment-Based Visas
USCIS is accepting AOS applications from applicants whose priority date falls before the Final Action Dates chart for June 2023. The EB-1 category for India and China shows no movement in June. The cutoff date for Indian and Chinese EB-1 applicants remains February 1, 2022. All other countries remain current. Even though there was potential retrogression in final action dates for China and India, it is not the case for June. But, with higher demand, we do expect to see retrogression in the July 2023 Visa Bulletin.
In the EB-2 category, the dates remain the same. There was no retrogression observed for June. Again, retrogression is expected in the July 2023 Visa Bulletin due to the increased demand. The cutoff dates for India and China remain unchanged at June 8, 2019, and January 1, 2011, respectively. The rest of the world, Mexico, and the Philippines remain at February 15, 2022.
There is no movement in the EB-3 category. The cutoff dates for the rest of the world, Central America, Mexico, and the Philippines remain at June 1, 2022. Chinese nationals have a cutoff date of April 1, 2019. Indian nationals have a cutoff date of June 15, 2012. The Department of State warns that this cutoff date will likely retrogress further in the future, possibly as early as July 2023. This is not surprising since many Indian nationals with both EB-2 and EB-3 I-140 approvals have transferred their AOS applications to EB-3 due to retrogression in the EB-2 category.
Family-Based Cases
USCIS continues to accept AOS applications based on the Date of Filing chart for June 2023. There is no movement in the Family-Based categories for June. The F-2A Family-Based category (Spouses and Unmarried Children under Age 21 of U.S. Green Card Holders) is no longer “current” for all countries except Mexico. The cutoff date for Mexico is November 1, 2018. For other countries, the Final Action cutoff date is set at September 8, 2020. Even though the Final Action Dates are no longer current, the Dates for Filing do remain current for the F-2A category. This means that while spouses and unmarried children of U.S. green card holders can still file their green card applications, these cases will not be processed until the priority date becomes current.
