The Biden Administration Announces Updates as Title 42 Expires and Title 8 Returns

Title 42, the Covid-19 public health order that limited entry to the U.S., comes to an end on May 11, 2023. This, however, does not mean a return to the previous status quo. The Biden Administration, in collaboration with world leaders in the Western Hemisphere, announced a series of changes to address immigration issues and curb the expected surge of migrants to the U.S. at the southern border.

Thousands of additional refugees from Venezuela, Nicaragua, Cuba, and Haiti will be accepted, on top of the already 30,000 agreed upon per month, in order to double the number of refugees as part of the Los Angeles Declaration on Migration and Protection (LADMP).

Furthermore, The Family Reunification Parole Processes for Cuba and Haiti will be modernized. New processes will be created for El Salvador, Guatemala, Honduras, and Colombia. These new processes will allow qualified individuals with approved family-based petitions to be paroled into the U.S. on a case-by-case basis with eligibility for employment authorization.

World leaders, through the LADMP, commit to managing migration flows by opening regional processing centers (RPCs) where appointments can be made to visit the nearest RPC before traveling. RPCs are to be established in Colombia and Guatemala, with plans to expand to other Regional Partners throughout the Western Hemisphere.

The Biden Administration aims to expand lawful pathways, address root causes, and step-up enforcement of existing immigration laws to discourage migrants from taking risks to reach the U.S. southern border. As Title 42 expires and Title 8 returns, the Biden Administration announced the new approach to immigration.
