USCIS announced the extension of the temporary suspension of biometrics submission requirements for qualifying individuals filing Form I-539, Application to Extend/Change Nonimmigrant Status to H-4, L-2, or E nonimmigrant status. This extension is in effect to September 30, 2023.
The initial suspension of biometrics submission requirements reduced USCIS’ processing times for these applications. The extension of the suspension helps USCIS to continue to process these applications more efficiently.
During this period, USCIS will use biographic information and background checks to adjudicate these applications. Applicants will not be required to submit fingerprints or photographs unless USCIS determines there is a need. USCIS may request biometric information on a case-by-case basis.
Qualifying individuals will not have to pay the $85 biometric services fee during the suspension period. USCIS will refund the fee if it has been submitted separately from the base fee. However, if the biometric fee was paid along with the base matter fees, the paper Form I-539 application will be rejected. In this case, individuals must file Form I-539 again without the biometric service fee.
