A lawsuit has been filed against an Alabama car parts manufacturer due to differences between the role the individual was hired to fill and their actual employment. This is the second such lawsuit that has been filed. The manufacturer is being sued by a group of foreign workers who claim they were hired through the TN visa to fill highly skilled engineering roles but were instead placed in manufacturing roles. As a result, the workers state they are being underpaid and forced to work excessive hours.
The TN visa is a Trade NAFTA visa. The purpose of this visa is to bring highly skilled individuals to fill roles in the U.S. The company allegedly enticed Mexican individuals with misleading job descriptions, advertising roles in engineering. Once the visa was obtained, the individuals claim they were put on the manufacturing line. This violates visa requirements.
Last year, a similar lawsuit was filed for a different recruiting firm with the same issue.
